Welcome to AutoRebuild Fax ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms," "Agreement") govern your access to and use of our platform, including all features, services, and content (collectively, the "Service"). By accessing or using AutoRebuild Fax, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our platform.

1. Eligibility & Account Registration

a. Eligibility

By using AutoRebuild Fax, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding agreements
  • All information provided is true, accurate, and complete
  • You are not using the Service for any illegal or unauthorized purpose
b. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept full responsibility for any activities that occur under your account. You must notify us immediately of any unauthorized access or breach of security.

2. Use License & Restrictions

a. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes, subject to these Terms.

b. Prohibited Uses

You agree not to:

  • Violate any applicable laws or regulations
  • Use the Service for fraudulent or malicious purposes
  • Attempt to gain unauthorized access to our systems or networks
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Remove, alter, or obscure any proprietary notices or labels
  • Use the Service to spam, harass, threaten, or defame others
  • Interfere with the operation or availability of the Service
  • Upload viruses, malware, or other harmful code
  • Scrape, crawl, or automatically access the Service without permission
  • Resell or redistribute access to the Service

3. Vehicle & Inspection Services

a. Service Description

AutoRebuild Fax provides a platform for vehicle inspections, rebuilds, test drives, maintenance tracking, and related automotive services. We connect users with inspectors and facilitate service delivery, but we are not responsible for the quality, accuracy, or completeness of services provided by third parties.

b. Accuracy of Information

You are solely responsible for the accuracy of vehicle information, photos, and details you provide. Inspection reports, rebuild assessments, and valuation estimates are provided for informational purposes and do not constitute professional advice. We recommend independent verification of all critical information.

c. Inspector Assignment

We make reasonable efforts to assign qualified inspectors to your requests, but we do not guarantee specific inspector qualifications or availability. Inspectors are independent contractors and not our employees.

d. Inspection Reports

Inspection reports are prepared based on visual inspection and available information. Reports do not guarantee the condition, safety, or legality of vehicles. Professional reviews by certified mechanics or engineers may be necessary for critical purchase decisions.

4. Subscriptions & Billing

a. Subscription Plans

Subscription plans renew automatically on the date specified at purchase. You authorize us to charge the payment method on file for renewal fees. Failure to provide valid payment information may result in service suspension.

b. Cancellation & Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months or unused services, except as required by law. Upon cancellation, your account access will be revoked at the end of the billing period.

c. Price Changes

We reserve the right to change subscription prices at any time. Price changes will be effective for new subscriptions immediately and for existing subscriptions upon renewal. We will notify you of price increases at least 30 days in advance.

d. Payment Processing

Payments are processed securely through Stripe, a third-party payment processor. By providing payment information, you authorize Stripe to charge your card or bank account. You acknowledge that you have reviewed Stripe's privacy policy and terms of service.

5. Intellectual Property Rights

a. Company IP

All content, features, and functionality on AutoRebuild Fax — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.

b. User Content

You retain ownership of any content you submit (photos, descriptions, reports). By submitting content, you grant us a worldwide, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and improving the Service.

c. Limited License

Except as explicitly granted in these Terms, no licenses or rights are granted to you regarding Company intellectual property. You may not reproduce, distribute, or transmit any content without our express written permission.

6. User Conduct & Disputes

a. Prohibited Content

You agree not to post or transmit content that is:

  • Defamatory, harassing, abusive, or threatening
  • Obscene, vulgar, or sexually explicit
  • Discriminatory based on race, gender, religion, or other protected status
  • Infringing on intellectual property rights
  • Misleading or fraudulent
b. Dispute Resolution

For disputes between users or between users and the Company, you agree to attempt good-faith resolution before pursuing legal action. If resolution is unsuccessful, disputes shall be governed by these Terms and applicable law.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Uninterrupted or error-free operation
  • Accuracy or completeness of information

We do not warrant that the Service will meet your requirements, be available without interruption, or be free from errors or defects.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

  • Direct, indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or anticipated savings
  • Business interruption or loss of opportunity
  • Damages caused by third-party services or inspectors

In jurisdictions where liability cannot be limited, our liability shall be limited to the amount paid by you in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of third-party intellectual property rights
  • Your breach of any law or regulation

10. Suspension & Termination

a. Termination by Company

We may suspend or terminate your account without notice if we determine that you have violated these Terms, engaged in fraudulent activity, or violated applicable laws. Suspension or termination may result in loss of access to your account and all associated data.

b. Termination by User

You may terminate your account at any time by contacting support. Upon termination, your right to use the Service immediately ceases, though your data may be retained as required by law.

c. Survival

Sections regarding intellectual property, limitation of liability, indemnification, and governing law shall survive termination.

11. Third-Party Services & Links

The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is governed by their terms and privacy policies. We do not endorse any third-party services.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the Service after modifications constitutes acceptance of the revised Terms. For material changes, we will provide 30 days' notice.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the federal and state courts located in New York County for the resolution of any disputes.

14. Severability & Waiver

a. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

b. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
